1. Conclusion of the contract and scope

1.1 The general terms and conditions (GTC) apply to all products and services of Bloom Bloom By Huma Ahmad-Barras www.bloombloom.ch website. For the business relationship between Bloom Bloom By Huma Ahmad-Barras and the customer in connection with the provider's online shop, under the domain www.bloombloom.ch , only the following terms and conditions apply in the version valid at the time of the order.

1.2 The following contractual conditions apply exclusively to the business relationship between Bloom Bloom By Huma Ahmad-Barras and the customer. Bloom Bloom By Huma Ahmad-Barras does not recognize any deviating conditions of the customer except that it has primarily agreed to their validity in text form.



1.3 Via the website www.bloombloom.ch , Bloom Bloom By Huma Ahmad-Barras offers a subscription for deliveries of fresh cut flowers, branches and foliage (hereinafter referred to as "flower products"). As a customer, you can purchase the offered products via the website, by taking out a subscription (contract for a regular order of service) or on the basis of an individual contract (contract for a one-off order).

1.4 Our flower products are individual natural products. These may differ from the color, shape and size information, as well as the images on the website, on the brochures and other advertising materials and are only to be understood as examples.

1.5 Subscriptions for flower products are taken out in cartons and with the unbound loose cut flowers contained therein, ie the customer receives the agreed number of Bloom Bloom packages, including a package of flower products. The choice of flower products in terms of type, color and scope is made exclusively by Bloom Bloom By Huma Ahmad-Barras. The number of stems per package can vary depending on the size and value of the individual flowers, with the flower products always remaining comparable in terms of value and overall impression. The flower products are usually cleaned, cut and provided with or without a damp wet bag. The subsequent dispatch will then take place by a transport company of Bloom Bloom By Huma Ahmad-Barras’ choice to the delivery address provided by the customer.

1.6 The flower products are generally not suitable for consumption by humans or animals. Bloom Bloom By Huma Ahmad-Barras does not take any responsibility for allergies which may arise from their flower products.


2. User account, registration, newsletter

2.1 The customer has the possibility to create a user account in the online store www.bloombloom.ch by registering with an e-mail address and a password chosen by the customer. This is done, among other things, during the ordering process. The order of a subscription requires a user account. The successful registration will be confirmed with a confirmation e-mail sent by us for your user account. With this user account you can manage your customer data such as delivery address and your subscription yourself. You agree to keep your customer and payment data always up to date.

2.2 The customer has the option to terminate his user account at any time. Your privacy as a customer is an absolute priority. Your personal data will be deleted immediately. The information and data are only used expressly to fulfill the subscription until the last contractually owed delivery has been made. Your e-mail address and your personal data will be treated confidentially and will not be passed on to third parties. For more information, please refer to the privacy policy. If the customer has chosen a passive term of his subscription and thus pauses the delivery, the customer's obligation to pay is also suspended. When the subscription is resumed, the obligation to deliver and pay is continued.



3. Conclusion of the contract

3.1 All offers by Bloom Bloom By Huma Ahmad-Barras on bloombloom.ch are non-binding.

3.2 The contract between the customer and Bloom Bloom By Huma Ahmad-Barras only comes into existence through an order from the customer and its acceptance by Bloom Bloom By Huma Ahmad-Barras and its online shop Bloom Bloom.

3.3 The customer's order is placed when the customer places his order via the online shop www.bloombloom.ch. Orders are generally confirmed with an order confirmation email. In addition, the customer can view, change and delete his order data in his user account at any time.

3.4 The customer can change his order data, customer data and contract date, the cut-off date for changes is approx. up until the Sunday before the next delivery. In addition, the customer has the option to completely end his subscription. If the customer would like to end the subscription, the data created by him will be completely deleted after the last delivery has been completed. If the customer has chosen a passive term of his subscription and thus pauses the delivery, the customer's obligation to pay is also suspended. When the subscription is resumed, the obligation to deliver and pay is continued.

3.5 First orders, pauses, changes and cancellations can always be made up to midnight on Sunday, before the next delivery is due. The timely confirmation of the entries made by the customer in the ordering process at www.bloombloom.ch is decisive for the timely receipt of orders and changes. Late first orders and changes in the order process or user account will only take effect from the next possible delivery date.

4. Right of withdrawal / return, guarantee

4.1 We care an awful lot about the flowers we send to our customers. If you’re ever unhappy with the freshness and we agree that they’re not up to scratch, we will, at our discretion, offer you a discount on your next delivery, or send out a replacement box on the next available date.

We only pick the freshest, most beautiful flowers we can, but not everyone likes surprises –We hope you’ll love them all, but we cannot be held responsible if you receive any flowers that aren’t to your taste or that are unsuitable for you or your pets.

4.2 The goods are to be checked visually upon delivery and receipt. Any hidden defects can be complained about within the granted durability guarantee via email at flowers@bloombloom.ch. The complaint must be made immediately after discovery, otherwise the goods will be considered accepted. If our flower products are returned or handed over to the carrier, the risk is transferred to the customer.

5. Pricing, terms of payment, retention of title

5.1 The prices quoted for the subscription at the time the order is placed are final prices and include the applicable Swiss value added tax of 2.5% and any fees and shipping costs.

5.2 Bloom Bloom By Huma Ahmad-Barras offers various credit card payment options, under the secure stripe system.

5.3 In the case of a return debit or a credit, we ask the customer to provide us with his account details so that the credit can be made immediately.

6. Delivery and shipping costs

6.1 Delivery is generally made as a one-off or a weekly, fortnightly and/or monthly depending on the subscription category. The day of delivery, unless otherwise agreed, is always Thursday.

6.2 Delivery on time and in accordance with the order requires that the customer provides correct address details. Any liability for any delays in mail delivery is excluded. The customer is obliged to keep the data entered by him for the recipient address in his user account up to date.

6.3 Bloom Bloom by Huma Ahmad-Barras cannot take responsibility or be held liable for delays in receiving orders due to issues with the third-party delivery handler (Swiss Post).

6.4 The delivery takes place from the existing range of seasonal flowers and is individually and freshly put together according to our standard. However, there is no claim to specific colors, types and / or combinations.

6.5 The costs for a standard delivery (PostPac Priority), with the pro-clima options are included in the price.

6.6 There will be no deliveries on Sundays and public holidays, unless there are separate instructions on www.bloombloom.ch. Please think specifically of cantonal or local holidays. Usually there is no delivery to these by the post office. If these are disregarded, we cannot accept any liability.

7. Changes to payment methods and address data

7.1 Changes to customer data, recipient address, billing address, e-mail address and any changes to existing orders as well as changes to payment methods must be made via “My Account”, using your login details on the website www.bloombloom.ch by mid-night of the Sunday before the next delivery is due.

8. Liability and Warranty

Bloom Bloom By Huma Ahmad-Barras does not accept any liability for direct damage of goods, by third party handlers.

9. Termination of the contract and duration of the contract

9.1 Any notice of termination that is not received by Sunday at midnight before the next dispatch date only becomes effective on the following week.

10. Place of jurisdiction

10.1 The domicile and place of jurisdiction is Niederlenz AG, Switzerland.

10.2 Swiss law is exclusively applicable to this contract.

10.3 Should individual provisions of these terms and conditions contradict the statutory provisions and be ineffective, the rest of the provisions shall remain unaffected.
